These Terms of Service (“Terms”) govern your access to and use of QuickDM (the “Service”), operated at quickdm.store. By creating an account or using the Service, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Service.

1. The Service

QuickDM provides software that helps Instagram Business and Creator accounts automate comment replies, direct messages, follow-related gates, lead capture, and related dashboard features using Meta’s official APIs, subject to platform availability and approval.

Features, limits, and plan entitlements may change. We may offer free trials, beta features, or experimental tools that are provided “as is” and may be modified or withdrawn.

2. Eligibility

You must be at least 18 years old (or the age of majority in your jurisdiction) and able to form a binding contract. You must have authority to connect any Instagram, Facebook Page, or business account you link to the Service.

3. Accounts

  • You are responsible for accurate registration information and for keeping credentials secure.
  • You are responsible for all activity under your account.
  • Notify us promptly at support@quickdm.store if you suspect unauthorized access.
  • We may suspend or terminate accounts that violate these Terms or create risk to the Service, Meta platforms, or other users.

4. Instagram and Meta platform rules

The Service depends on third-party platforms, primarily Meta Platforms, Inc. (“Meta”) and Instagram. You agree to:

  • Comply with Instagram Terms of Use, Meta Platform Terms, Community Guidelines, and any messaging / automation policies.
  • Use only Business or Creator accounts (as required by the API) that you own or are authorized to manage.
  • Not use the Service to spam, harass, deceive, or send unsolicited bulk messages in violation of law or platform rules.
  • Accept that Meta may change APIs, rate limits, or revoke app access; we are not liable for downtime or feature loss caused by Meta.

QuickDM is not affiliated with, endorsed by, or sponsored by Meta or Instagram. All third-party trademarks belong to their owners.

5. Acceptable use

You agree not to:

  • Violate any law, including anti-spam, privacy, consumer protection, and advertising rules.
  • Scrape, reverse engineer, or overload the Service except as allowed by law.
  • Probe or attack our systems, or those of Meta, without authorization.
  • Upload malware or content that is illegal, defamatory, or infringing.
  • Resell the Service without a written agreement, or share accounts beyond plan limits.
  • Misrepresent your identity or relationship to a brand when messaging users.
  • Use the Service for adult sexual content involving minors, scams, financial fraud, or other prohibited categories under Meta policies.

6. Your content and data

You retain ownership of content you submit (message templates, brand assets, automation settings). You grant us a limited license to host, process, and transmit that content solely to operate the Service.

You represent that you have all rights and consents needed to process comments, messages, and lead data of people who interact with your Instagram account through the Service, and to send them automated messages.

7. Plans, billing, and refunds

  • Paid plans are billed in advance on a monthly or annual cycle as selected at checkout (or as otherwise stated).
  • Prices are listed on the website and may change with notice for future billing periods.
  • Unless required by law or expressly stated in writing, fees are non-refundable once a billing period has started.
  • You may cancel auto-renewal; access continues until the end of the paid period.
  • Failed payments may result in suspension until resolved.

Taxes may apply depending on your location. You are responsible for any applicable taxes not collected by us.

8. Free trials

Free trials, if offered, may require account registration. We may limit trial features or duration. Converting to a paid plan may require a payment method.

9. Intellectual property

The Service, including software, branding, design, and documentation, is owned by QuickDM and its licensors. These Terms do not transfer any ownership to you. You may not copy, modify, or create derivative works of the Service except as expressly permitted.

10. Third-party services

The Service may integrate with third parties (Meta, payment processors, email providers, hosting). Your use of those services is subject to their terms. We are not responsible for third-party outages, policy changes, or data practices beyond our control.

11. Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT AUTOMATIONS WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT EVERY COMMENT OR MESSAGE WILL BE DELIVERED, OR THAT USE OF THE SERVICE WILL INCREASE FOLLOWERS, SALES, OR ENGAGEMENT.

12. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, QUICKDM AND ITS AFFILIATES, OFFICERS, AND SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, GOODWILL, OR BUSINESS OPPORTUNITY, ARISING FROM OR RELATED TO THE SERVICE OR THESE TERMS, WHETHER BASED ON WARRANTY, CONTRACT, TORT, OR ANY OTHER LEGAL THEORY.

OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICE OR THESE TERMS WILL NOT EXCEED THE AMOUNTS YOU PAID US FOR THE SERVICE IN THE TWELVE (12) MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM (OR INR 5,000 IF YOU HAVE NOT PAID US).

Some jurisdictions do not allow certain limitations; in those cases, our liability is limited to the fullest extent permitted by law.

13. Indemnification

You will defend and indemnify QuickDM against claims, damages, losses, and expenses (including reasonable legal fees) arising from: (a) your content or automations; (b) your misuse of the Service; (c) your violation of these Terms or of Meta/Instagram rules; or (d) your violation of third-party rights, including privacy rights of people you message.

14. Suspension and termination

You may stop using the Service at any time and request account deletion. We may suspend or terminate access immediately if you violate these Terms, create risk of harm, or if Meta restricts our app. Upon termination, sections that by nature should survive (including ownership, disclaimers, limitations, and indemnity) will survive.

15. Changes to the Service or Terms

We may modify the Service and these Terms. We will update the “Last updated” date and, for material changes, provide additional notice when reasonable. Continued use after changes become effective constitutes acceptance.

16. Governing law

These Terms are governed by the laws of India, without regard to conflict of law principles, unless mandatory consumer protections in your country require otherwise. Courts in India shall have exclusive jurisdiction, subject to any non-waivable rights you may have.

17. Miscellaneous

  • These Terms are the entire agreement between you and us regarding the Service.
  • If any provision is unenforceable, the remainder stays in effect.
  • Failure to enforce a provision is not a waiver.
  • You may not assign these Terms without our consent; we may assign them in connection with a merger or sale.
